Facility Usage Requirements as Established by the Directors of
The Mixon, Texas Cemetery Association.
This document is to be distributed/reviewed with the Family/Representatives at the time of Plot Reservation or during the burial/funeral arrangement services process.
This document may be revised or amended by the Board of Directors as needed. “Gravesite” shall mean a single individual 4 ft x 8 ft plot or place of interment throughout this document.
A. General Information
1. The Association reserves the right to resurvey, enlarge, reduce, replat, alter shape or size or change any or all part of the subdivision of the property as presently mapped and platted, including the right to modify or change the location of roadways, walks, drives or unassigned lots as the need is determined by the board.
2. The Association reserves the right to withhold granting of easements and right of ways over and through the premises unless the purpose benefits the greater good of the cemetery or community.
3. The care of the Cemetery premises shall be undertaken only by the Association. All grading, landscaping, trimming, plantings, mowing, removal of trees, shrubs and herbage of any kind shall be undertaken only under the direction of the Board. Plantings of flowers and small shrubberies are not permitted. The Association reserves the right to remove any such installed unauthorized landscaping should they interfere with the maintenance operations or are deemed to be in bad taste or objectionable to the overall pleasant appearance of the cemetery grounds.
4. All openings and closings of gravesites shall be under the supervision of the Association with prior approval by the Association. There will be no opening of graves prior to verification of eligibility and payment of the interment fee to the Mixon, Texas Cemetery Association.
5. All improvements or alterations of individual gravesites such as the installation of headstones, statues, benches, and other improvements shall be under the direction of and subject to the consent and approval of the Association. The Association reserves the right and authority to remove any and all floral arrangements, flowers, weeds, trees, shrubs, plantings or herbage of every kind from the cemetery as soon as they have become unsightly, dangerous, dead or diseased or detrimental to the overall pleasant aesthetics of the cemetery grounds. The Association and the Board will not be liable for damage to any floral designs/arrangements, baskets, frames, containers, shepherd’s crooks, statuaries etc. to which the floral pieces/plants or decorations are attached.
6. To facilitate mowing and maintenance, raising or depressing the surface of a gravesite above or below the surrounding ground is strictly prohibited, except by special permission of the Board. Depressions caused by settlement shall be filled in by the Association from time to time and seeding added to the gravesite. No artificial flowers, wreaths or other such arrangements may be placed in the normal mowing areas of the cemetery. Glass or easily breakable containers should not be used to hold decorations at the gravesite.
7. In general, gravesites are not to be decorated with mulch, architectural stones/gravel/marbles or the like. No metal installations such as shepherd’s crooks, spikes, golf pins/tees, sports memorabilia, toys, etc. No spikes or reinforcing bars should be installed in the ground to secure flowers as these interfere with mowing and can damage mowers.
8. While headstone owners are generally responsible for the upkeep of their individual headstones, the Association’s negligence in operating its equipment and causing damage supersedes the individual owner’s responsibility. In essence, the Association will be the responsible party for necessary repairs to a headstone damaged by the Association’s mowing/maintenance contractors.
9. The Association disclaims all responsibility for loss or damage from causes beyond its reasonable control; elements of nature, Acts of God, thieves, vandals, malicious mischief makers, livestock, explosions, unavoidable accidents, and civil or military authorities whether such damage is by direct or collateral.
B. Gravesite or Plot Assignments
1. The Association shall maintain records of the name of each plot or gravesite assignment.
2. No transfer or assignment of any plot or gravesite shall be valid until the consent of the Association has been obtained and the same has been recorded on the books and records of the Association.
3. The Maintenance Fee for an individual plot or gravesite ($500.00) shall be paid at the time of burial unless an alternate payment plan has been expressly agreed upon in writing by the Association.
4. Should any assignee/designee of a lot or gravesite wish to relinquish previously reserved plots or gravesites, they may tender the same back to the Association.
5. Plots or gravesites for full body burials will be assigned/designated to one single individual. There will be no multiple assignments to a single plot for full body burials. For families or groups that desire to reserve plots near each other, each individual person will need to be assigned a specific plot.
6. For those families who wish to have their cremated remains buried using one plot or gravesite; at the time of reservation of the plot or gravesite the names of all members using the plot or gravesite for cremated remains will need to be recorded.
Cremains burials will require their own individual maintenance fee irrespective of the number of plots or gravesites used.
C. Use of Cemetery Premises
1. The grounds of the cemetery shall generally be open and accessible to all visitors during daylight hours. Burials shall be coordinated in advance with the Association. During the conduct of funerals, access to the cemetery may be restricted or limited. The Board reserves the right tolimit, restrict or deny access to the cemetery premises and establish rules for such access.
2. The Association has the right to ask anyone visiting the cemetery to identify themselves and present proper identification, upon request.
3. While within the cemetery, all persons shall use only the roads, drives and walkways that are provided. Bicycles and motorcycles shall not be allowed on the grounds other than on the roads and drives. When parking vehicles, keep one set of wheels on the pavement and take care not to hit markers or monuments.
4. In no event shall the Association or any Board Member be held liable for any injuries sustained by any visitor to the cemetery premises.
5. Pets are not allowed in the cemetery grounds unless leashed and controlled.
6. Children under the age of twelve (12) years shall not be permitted within the cemetery unless accompanied by a responsible adult (18 or older) to supervise and care for them.
7. Persons other than plot or gravesite family members are not permitted to loiter in the cemetery. No solicitors of any kind shall be allowed.
D. Interments and Disinterment
1. All grave openings, closings and interments of every kind shall be done only under the supervision of the Association. Every full body burial shall have the casket enclosed in a steel vault. No mausoleums or above-ground burials are permitted.
2. Maintenance fees are to be paid in full prior to grave being dug.
3. Cremains burials shall require their own individual maintenance fee.
4. No vertical stacking of caskets or vaults shall be permitted.
E. Headstones, Monuments and Other Fixed Installations
1. The purchase and installation of monuments or headstones shall be the sole responsibility of the family or the buried decedent or other responsible person and will remain property owned by the Designee Family. Monuments or headstones shall be made of granite, marble or metal and shall be installed by a qualified monument company on an appropriately sized footer. All such installations shall be coordinated in advance with the Association within twelve (12) months of the burial date.
2. All monuments and headstones shall be dignified and tasteful in appearance. Should any monument or headstone, sign or other structure or any inscription placed in or upon the plot or gravesite be determined to be inappropriate, offensive, improper or injurious to the appearance of the surrounding lots or grounds, the Association shall have the right to enter upon such plot or gravesite and cause the removal of said offensive, inappropriate or improper object(s).
3. If after twelve (12) months, no permanent marker has been installed, the Association may, at its discretion, install a cost-effective permanent marker.
F. Miscellaneous Provisions
1. All persons are prohibited from gathering or borrowing flowers, either wild or cultivated or breaking tree branches, shrubbery or plants on the grounds.
2. No picnicking on the cemetery grounds shall be permitted, unless specifically authorized by the Board.
3. No fireworks shall be permitted under any circumstances.
4. Boisterous or disrespectful conduct shall not be permitted on the grounds.
5. Littering anywhere on the cemetery grounds is strictly forbidden. Any wilted or dead flowers or other trash should be removed from the cemetery grounds. The family members of loved ones buried in the cemetery should police their plots and gravesites within reason whenever possible to maintain them in a neat and orderly manner.
6. No signs or advertisements of any kind shall be allowed in the cemetery unless placed and approved by the Association.
7. Any settling or subsidence of earth on gravesites and any other problems with grass cover or depressed surface areas that are noticed by visitors should be reported promptly. The Association will strive to address all such issues in a prompt manner.
